1. Introduction
Welcome to FlexMo. These Terms and Conditions (“Terms”) govern your use of the FlexMo installment-based device financing service (“Service”) offered through our partnered retailers. By entering into a device financing agreement with FlexMo, you agree to abide by the Terms outlined herein.
2. Definitions
- “FlexMo” refers to the brand and company facilitating installment-based payment plans.
- “Retail Partner” refers to any third-party vendor authorized to offer devices with FlexMo payment options.
- “Device” means any mobile phone or electronic product purchased under a FlexMo agreement.
- “Customer” refers to the individual entering into a financing agreement with FlexMo.
3. Eligibility
To use the Service, you must:
- Be a Sri Lankan citizen aged 18 or above
- Possess a valid National Identity Card (NIC)
- Provide verifiable proof of income as requested by FlexMo or the Retail Partner
FlexMo reserves the right to decline service to any applicant at its sole discretion.
4. Ownership & Usage
- The Device remains the property of FlexMo until all installments and applicable fees are fully paid.
- The Customer is granted conditional usage rights of the Device during the installment period.
- Any attempt to sell, pawn, lease, gift, or transfer ownership of the Device before completing full payment is strictly prohibited and constitutes a violation of these Terms.
5. Payment Terms
- The Customer is required to make an initial upfront payment followed by a series of monthly installments, as agreed at the time of purchase.
- Interest rates and any applicable late fees will be clearly communicated at the time of initiating the loan agreement and may vary between cases.
- The loan agreement is physically signed by the Customer at the Retail Partner’s location. This signed document is legally binding.
- No refunds will be provided once the agreement is signed. The full loan must be repaid in all circumstances.
6. Default & Enforcement
In the event of default or breach of terms, including but not limited to missed payments, attempts to pawn or sell the Device, or fraudulent declarations:
FlexMo reserves the right to:
- Remotely lock or disable the Device using its mobile device management (MDM) system
- Initiate debt recovery procedures, which may involve third-party collection agents
- Blacklist the Customer’s NIC with relevant authorities or internal watchlists
- Report the incident to law enforcement for legal action under fraud, theft, or other applicable penal codes
The Customer acknowledges and consents to these enforcement mechanisms by agreeing to these Terms.
7. Device Monitoring
FlexMo reserves the right to remotely monitor device status using mobile device management (MDM) software for compliance and enforcement purposes. This monitoring may include:
- Device location and activity status
- Device lock status and usage patterns
FlexMo does not access personal data and adheres to all applicable data privacy guidelines.
8. Privacy
FlexMo collects and processes only the data necessary for identity verification, financial assessment, contract enforcement, and service delivery. This may include:
- Full name and NIC
- Proof of income
- Contact information
- Loan history and repayment data
Your data will not be shared with third parties except for legal, operational, or regulatory requirements.
9. Termination
FlexMo may terminate or suspend your account or device access at any time in case of violation of these Terms. In such cases, the Customer remains liable for the outstanding loan balance.
10. Limitation of Liability
FlexMo shall not be held liable for any indirect, incidental, or consequential damages arising from:
- Device malfunctions not caused by FlexMo
- Delays caused by Retail Partners
- Customer misuse or mishandling of the Device
11. Governing Law
These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of Sri Lankan courts.
12. Changes to Terms
FlexMo may update these Terms at any time. Updated Terms will be posted on the official FlexMo website. Continued use of the service constitutes acceptance of the revised Terms.
By using FlexMo, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
